Apologies for absence were received from Councillors Dutton and Page.

Declarations of Interest

Members are requested at a meeting where a disclosable pecuniary interest or personal interest arises, which is not already included in their Register of Members' Interests, todeclare any interests that relate to an item on the agenda.

 

Where a Member discloses a Disclosable Pecuniary Interest, he/she must withdraw from the meeting room, including from the public gallery, during the whole consideration of any item of business in which he/she has an interest, except where he/she is permitted to remain as a result of a grant of a dispensation.

 

Where a Member discloses a personal interest he/she must seek advice from the Monitoring Officer or staff member representing the Monitoring Officer to determine whether the Member should withdraw from the meeting room, including from the public gallery, during the whole consideration of any item of business in which he/she has an interest or whether the Member can remain in the meeting or remain in the meeting and vote on the relevant decision.

Exclusion of Press and Public

The following report is not Exempt/Confidential, but includes appendices which contain exempt information as defined in Paragraph 7a of Part 1 of Schedule 12A under Section 100A(4) of the Local Government Act 1972. Namely,

Members are therefore requested to indicate whether or not they wish to discuss any matters referred to in the exempt appendices and accordingly, consider passing the following resolution:

 

That, under Section 100A(4) of the Local Government Act, 1972, the press and public be excluded from the meeting for any items of business which might involve the likely disclosure of exempt information as defined in Paragraph 7a of Part 1 of Schedule 12A to the Act. The Public Interest Test has been applied and favours exclusion of the information from the Press and Public.

The Committee considered the report of the Chief Planning Officer on the re-issue of the Safety Certificates for two regulated viewing grandstands at Southport Football Club’s Haig Avenue Stadium which were to be re-issued to include the name of the Club’s new Safety Officer. In addition, the Safety Certificate for the Main Grandstand was to be re-issued to reflect a minor increase in its capacity.

 

RESOLVED:

 

That the re-issue of the General Safety Certificates for the Main Grandstand and the Jack Carr Stand at Southport Football Club’s Haig Avenue Stadium be granted. In the case of the Main Grandstand, the Chief Planning Officer would re-issue the Main Grandstand Safety Certificate (on behalf of the Committee) upon completion of minor works to install 16 additional seats.

The Committee considered the report of the Head of Highways and Public Protection on the receipt of an objection against a proposal to introduce traffic calming on Southport Road and Ince Road, Thornton.

 

RESOLVED: That

 

(1)  the objection be noted;

 

(2)  the traffic calming scheme be progressed as originally advertised; and

 

(3)  the objector be advised accordingly.

That the proposed fees and charges for 2019/2020 be endorsed and approved as listed in the Annex attached to the report.

The Committee considered the report of the Head of Highways and Public Protection which sought the approval of Members for the fees and charges for Taxi Licensing Services in 2019/2020.

 

RESOLVED: That

 

(1)  the 2.4% uplift for all fees (subject to rounding to the nearest £) in 2019/2020 be approved;

 

(2)  the Head of Highways and Public Protection be authorised to advertise the revised fees and charges and set an implementation date of Monday 1 April 2019; 

 

(3)  consideration of an additional £50 fee for new driver applications and a £10 fee for additional knowledge tests be deferred to the meeting of the Licensing and Regulatory Committee to be held on Monday 18 March 2019; and 

 

(4)  the Head of Highways and Public Protection be authorised to advertise the revised Licence fees and charges and set an implementation date of Monday 1st April 2019

Determinations made under the Licensing Act 2003 and the Gambling Act 2005: period covering 18 August 2018 to 14 December 2018 pdf icon PDF 226 KB

The Committee considered the report of the Head of Highways and Public Protection updating on applications made under the Licensing Act, 2003 and the Gambling Act 2005, which had been determined by Licensing Officers.

 

The report indicated that Sefton Council’s Statement of Licensing Policy (issued under the Licensing Act 2003) and the Statement of Gambling Policy (issued under the Gambling Act 2005), both followed the recommended delegation of functions contained within the Guidance issued under Section 182 of the Licensing Act 2003 and the Guidance issued under Section 25 of the Gambling Act 2005.  Where there are no relevant representations to applications, then these matters would be dealt with by Officers in order to speed matters through the system. The Guidance also recommended that where powers had been delegated, the Committee would receive regular reports on decisions made by Officers in order to maintain an overview of the general licensing situation.

 

The report indicated that during the period 18 August 2018 to 14 December 2018 the Head of Highways and Public Protection had received and determined the following numbers of applications:

 

Under the Licensing Act 2003:

 

  • 102 Applications made under Premise Licences
  • 56 Applications made under Personal Licences
  • 1 Application made under Club Premise Certificates 
  • 123 Notifications of Temporary Event Notices
  • 46 Notifications of Late Temporary Event Notices

 

Under the Gambling Act 2005:

 

·         2 Application made under Licensed Premises Gaming Permits

  • 4 Notifications given for Licensed Premises Automatic Gaming

 

Details of the determinations were indicated in annexes 1 and 2 of the report.

That the report and the fact that further update reports would be submitted as necessary be noted.
