Report of the Head of Regulation and Compliance

Minutes:

Further to Minute No. 4 of the meeting of the Licensing and Regulatory (Urgent Referrals) Committee held on 13 July 2017, the Committee considered the report of the Head of Regulation and Compliance, which provided an update on the implementation of the Public Space Protection Order (PSPO), as legislated for under the Anti-Social Behaviour Crime and Policing Act 2014, to combat ticket touting at the 2017 Golf Open Championship, at the Royal Birkdale Golf Club.

 

The report also outlined possible ways forward with regard to ticket touting at the Aintree Grand National Festival.

 

RESOLVED: That

 

(1)             the report and its contents be noted; and

(2)             the actions proposed within the report be endorsed.

The Committee considered the report of the Head of Regulation and Compliance updating on applications made under the Licensing Act, 2003 and the Gambling Act 2005, which had been determined by Licensing Officers.

 

The report indicated that Sefton Council’s Statement of Licensing Policy (issued under the Licensing Act 2003) and the Statement of Gambling Policy (issued under the Gambling Act 2005), both followed the recommended delegation of functions contained within the Guidance issued under Section 182 of the Licensing Act 2003 and the Guidance issued under Section 25 of the Gambling Act 2005 and that where there were no relevant representations to applications, then these matters would be dealt with by Officers in order to speed matters through the system. The Guidance also recommended that where powers had been delegated, the Committee would receive regular reports on decisions made by Officers in order to maintain an overview of the general licensing situation.

 

The report indicated that during the period 27 May 2017 to 4 August 2017 the Head of Regulation and Compliance had received and determined the following numbers of applications:

 

Under the Licensing Act 2003:

 

  • 71 Applications made under Premise Licences
  • 34 Applications made under Personal Licences            
  • 83 Notifications of Temporary Event Notices
  • 34 Notifications of Late Temporary Event Notices

 

Under the Gambling Act 2005:

 

·         2 Applications made under Gambling Premise Licences

  • 1  Application made under Licensed Premises Gaming Permits
  • 2  Notifications given for Licensed Premises Automatic Gaming

 

Details of the determinations were indicated in annexes 1 and 2 of the report.

 

RESOLVED:

 

That the report and the fact that further update reports would be submitted as necessary be noted.

Report of the Head of Regulation and Compliance

The Committee considered the report of the Head of Regulation and Compliance on proposed changes to the medical examinations for hackney carriage and private hire drivers.

 

The report indicated that the Council had adopted the Group 2 medical as the standard for all licensed drivers in 2008 but had been using its own medical assessment documentation since that time and that it was now proposed to use an assessment similar to the current DVLA D4, Group 2 (lorry or bus licence) attached at Annex 1 to the report, which was also the standard being adopted across the other Merseyside licensing authorities.

 

RESOLVED: That

 

(1)

the adoption of a medical assessment similar to the DVLA D4 Group 2 (lorry or bus) licence, for hackney carriage and private hire drivers, as indicated in Annex 1 to the report, be approved; and

 

(2)

the new Sefton version of the medical assessment be introduced in October 2017, following consultation with the Hackney Carriage and Private Hire Trade about the forthcoming changes.

Further to Minute No. 5 of 20 March 2017, the Committee considered the report of the Head of Regulation and Compliance which provided a list of wheelchair accessible Sefton Council licensed hackney carriage and private hire vehicles as detailed in annexe 1 to the report.

 

The report indicated that the list was made under the Equality Act 2010 and sections 165 (passengers in wheelchairs) and 167 (lists of wheelchair-accessible vehicles) which introduced obligations and offences for discrimination against wheelchair users.

 

RESOLVED:

 

That the report be noted.
