The Committee considered the report of the Environmental and Technical Services Director on the proposed response to the Home Office Consultation document entitled, ‘A Consultation on Empowering Individuals, Families and Local Communities to Shape and Determine Local Licensing’, in respect of the future shape of the Licensing Act 2003, detailed in Annex 1 to the report.

 

Members discussed the Consultation responses in some detail and Mr. Coady, the Senior Licensing Officer and Mrs Cain, Solicitor, answered questions thereon.

 

Members raised concerns as to the occasional disparity between the

hours of operation of commercial premises under a planning consent and

the hours that may be granted by the Licensing Authority; and indicated that they would welcome a change to the legislation which would allow planning/building control to determine the use of the premises but would leave the Licensing Authority free to determine the hours.

 

RESOLVED: That

 

(1)

the report and its contents be noted;

 

(2)

the Environmental and Technical Services Director be requested to add the following paragraph to No. 29 of the Consultation response, namely:

 

“Concerns have been raised as to the occasional disparity between the hours of operation of commercial premises under a planning consent and the hours that may be granted by the Licensing Authority.

 

The Licensing Authority would welcome a change to the legislation which would allow planning/building control to determine the use of the premises but would leave the Licensing Authority free to determine the hours;"    and

 

(3)

subject to the insertion of the above addition,  the response to the Home Office Consultation on Empowering Individuals, Families and Local Communities to Shape and Determine Local Licensing’, in respect of the future shape of the Licensing Act 2003, be endorsed.

Cinemas Act 1985 - Film entitled 'Zift' pdf icon PDF 120 KB

Report of the Environmental and Technical Services Director

Minutes:

The Committee considered the report of the Environmental and Technical Services Director on the request from Mr. Sam Meech to exhibit the independently made film “Zift” at the Plaza Cinema, 13 Crosby Road North, Waterloo, as part of a weekly world cinema event to commence on 11 September 2010. It was anticipated that this film would not be exhibited until the end of the season in December 2010. The British Board Film Classification had not yet classified the film.  A synopsis of the film was detailed within the report.

 

Prior to any decision being taken, it was necessary for Members to view the film in its entirety. Accordingly, the Committee viewed the film immediately before the commencement of the meeting.

                              

RESOLVED:

 

That subject to the condition that no one under the age of 18 years old be permitted to view the film, the application to exhibit the film “Zift” at the Plaza Cinema, Waterloo, be approved.

 

Reasons:

 

Having viewed the film in its entirety, the Committee decided that given the  inclusion of scenes containing explicit sexual content and nudity, the film “Zift” was deemed not to be suitable for viewing by anyone under the age of 18 years old.
