That the Minutes of the meeting held on 21 September 2011 be confirmed as a correct record.

Minutes: Further to Minute No.22 of the meeting held on 29 June, 2011 the Committee considered the report of the Head of Planning Services on applications seeking variations to two conditions imposed on the recent approval for external works at the proposed Tesco store in Ainsdale to: firstly rescind the requirement of some highway works (application S/2011/1079); and secondly extend the opening hours at both ends of the day to achieve the stores’ standard 7.00am to 11.00pm (application S/2011/1088)
The report considered the issues raised and recommended that application S/2011/1079 be refused and application S/2011/1088 be approved subject to being altered to only allow opening 7.00am to 8.00am for the reasons stated or referred to in the report.
Prior to consideration of the applications, the Committee received petitions against both applications from Councillor Jones on behalf of objectors against to the proposed changes to the conditions and a response from the applicant’s agent, Ms. H. Knight.
RESOLVED: That
(1) the recommendation for application S/2011/1079 be approved and the application be refused for the reasons stated or referred to in the report; and
(2) the recommendation for application S/2011/1088 be approved and the application be granted as described above for the reasons stated or referred to in the report.

Application No. S/2011/1162 - 2-4 Westway, Maghull Minutes: The Committee considered the report of the Head of Planning Services recommending that the above application seeking the change of use from Retail (A1) to Restaurant (A3) including the installation of a new glazed front, layout of an external seating area facing Westway and exterior alterations be approved for the reasons stated or referred to in the report.
Prior to consideration of the application the Committee received a petition from Mr. Murphy on behalf of objectors to the application and a response from the applicant’s agent, Mr. Gee.
Councillor Mainey, as Ward Councillor, made representations on behalf of objectors against the proposed development.
RESOLVED:
That the recommendation be approved and the application be granted for the reasons stated or referred to in the report, and subject to an amendment to condition 14, to refer to the alleyways and an additional condition requiring reinstatement of the fence to the rear.

Application No. S/2011/1110 - 36 Marlborough Road, Southport Minutes: The Committee considered the report of the Head of Planning Services recommending that the above application seeking permission for the erection of 2 semi-detached three storey dwellings on vacant land adjacent to 36 Marlborough Road (alternative to S/2011/0582 refused 30 June 2011) be approved for the reasons stated or referred to in the report.
Prior to consideration of the application the Committee received a petition from Mr. Pitt on behalf of objectors to the application and a response from the applicant’s agent, Mr. Sedgwick.
RESOLVED:
That the recommendation be approved and the application be granted for the reasons stated or referred to in the report.

Application No. S/2011/1177 - 28 Phillips Lane, Formby Minutes: The Committee considered the report of the Head of Planning Services recommending that the above application seeking permission for the erection of a single storey extension to the side / rear together with a porch to the front of the dwellinghouse after demolition of the existing detached garage be approved for the reasons stated or referred to in the report.
Prior to consideration of the application the Committee received a petition from Councillor Doran on behalf of objectors to the application and a response from the applicant, Mr. Evans.
RESOLVED:
That the recommendation be approved and the application be granted for the reasons stated or referred to in the report.

Applications Inspected by the Visiting Panel - 17 October 2011 Report of the Head of Planning Services Minutes: The Committee considered the report of the Head of Planning Services that advised that the undermentioned sites had been inspected by the Visiting Panel on 17 October 2011.

Report of the Head of Planning Services and the Head of Investment Programme & Infrastructure. Minutes: The Committee considered the joint report of the Head of Planning Services and Head of Investment Programmes and Infrastructure that provided information of the content of the consultation draft 'Lower Alt with Crossens Pumped Drainage Catchment: Draft Flood Risk Management Strategic Plan: Consultation Document'. The report provided an overview of its key issues and potential implications, as the basis of a response to the Environment Agency.
RESOLVED: That
(1) the key issues and potential implications of the consultation draft 'Lower Alt with Crossens Pumped Drainage Catchment: Draft Flood Risk Management Strategic Plan' be noted;
(2) the Head of Planning Services and Head of Investment Programmes and Infrastructure be authorised to respond to the consultation on the basis of the issues detailed within section 3 of the report; and
(3) the Head of Planning Services and Head of Investment Programmes and Infrastructure be authorised to continue to engage with the Environment Agency regarding the Lower Alt with Crossens Pumped Drainage Catchment: Draft Flood Risk Management Strategic Plan.
