Minutes:

The Committee considered the report of the Head of Planning Services that recommended that the above application for the change of use from retail/workshop (Class A1) to hot food takeaway (Class A5) involving the installation of an extraction flue be granted subject to the conditions and for the reasons stated or referred to in the report.

 

Arising from the discussion a Member enquired if the appearance of the flue as part of the application could be lessened by it being an appropriate colour.

 

RESOLVED:

 

That the recommendation be approved and the application be granted subject to the conditions and for the reasons stated or referred to in the report and subject to an additional condition requiring the flue to be provided to be of an appropriate colour in accordance with details to be approved by the Head of Planning Services.

Application No. DC/2015/02016 - Former Maghull Library and Youth Centre, Liverpool Road North, Maghull pdf icon PDF 718 KB

Minutes:

The Committee considered the report of the Head of Planning Services that recommended that the above application for the erection of a single storey building to be used as a food store (A1 retail use), with associated car parking, servicing and landscaping after demolition of the existing building be granted subject to the conditions and for the reasons stated or referred to in the report.

 

Following publication of the report the applicant had requested a review of planning conditions, largely to address concerns relating to pre commencement conditions and for the avoidance of doubt the full revised schedule of conditions was set out in Late Representations.

 

Additionally, the Head of Planning Services gave a verbal update indicating that the first paragraph of condition 3 as submitted should be amended as follows:-

 

a)       A detailed scheme of highway improvement works shall be submitted to and approved in writing by the Local Planning Authority. The works, notwithstanding the position of the bus stop shown on plan reference A-PL-103 Revision F, shall consist of the following:

 

Also Condition 14 referred to a restriction of 2100 on servicing, however, the report agreed to 2200, corresponding with the store closing. It was therefore requested that this condition be amended as follows:-

 

“No servicing shall take place to the premises outside the hours of 0600 and 2200 Monday to Saturday and 0800 and 2000 on Sundays and Bank Holidays.”

 

Also Condition No 22 in the report did not have an attached reason and Members were requested to agree the following reason:-

 

Reason:  In the interest of residential and wider visual amenity.

 

Arising from the discussion a Member referred to a recent decision of the Council’s Licencing Sub Committee to grant a premises Licence under the Licensing Act 2003 in respect of the proposed development. The Permission had included a condition for the applicant to arrange consultation meetings with residents of Beechcroft and the Member enquired if this could also be included as a planning Condition. The Head of Planning Services indicated that this could be included as an “informative”.

 

RESOLVED:

 

That the recommendation be approved and the application be granted subject to the conditions and for the reasons stated or referred to in the report, in Late Representations and as reported verbally at the meeting and with the inclusion of an informative regarding consultation meetings with the residents of Beechcroft.

Application No. DC/2015/00129 - Land bounded by Lunt Lane and Lunt Road, Sefton pdf icon PDF 643 KB

Minutes:

The Committee considered the report of the Head of Planning Services that recommended that the above application for the alteration and extension of vacant Old Lunt Farm Cottage to form a dwelling and the conversion and extension of the vacant Old Lunt Farm Barn to form a dwelling and sub-division of the site into three plots be granted (subject to the conditions and) for the reasons stated or referred to in the report and subject to the completion of a Section 106 Agreement to secure the completion of the works to Old Lunt Farm Cottage.

 

The report indicated that the proposed development constituted inappropriate development in the Green Belt but had been recommended for approval taking account of special circumstances put forward by the applicant that the proposed development would bring back into use the derelict former farmhouse which dated back to at least the 18th Century and was a building of considerable interest. Members discussed the proposal and expressed concerns at the principle of inappropriate development within the green belt and the size of the proposed extension to the existing barn in the context of other buildings within this rural location.

 

RESOLVED:

 

That the recommendation be not approved and the application be refused for the reason that:-

 

The proposal constitutes inappropriate development in the Green Belt which is, by definition, harmful to the Green Belt and the circumstances which the applicant has put forward as very special circumstances are not considered sufficient to outweigh the potential harm to the Green Belt. The proposal is therefore contrary to the provisions of the National Planning Policy Framework, in particular paragraphs 87 to 90 inclusive, and Sefton Unitary Development Plan policies CS2, CS3, GBC1 and GBC2

 

Justification

 

·         Size of extended barn will have a detrimental impact on the Green Belt and Conservation Area;

 

·         Not convinced that the proposed size of extension to the barn can be justified as “enabling development” to support the restoration of the farmhouse; and

 

·         Not convinced that the restoration of the farmhouse cannot be carried out independently.

Application No. DC/2015/01653 - 14 Windsor Road, Southport pdf icon PDF 490 KB

Minutes:

The Committee considered the report of the Head of Planning Services that recommended that the above application for the erection of two, two storey blocks of six and four apartments and the  erection of seven two storey dwellinghouses and two bungalows with associated landscaping and works (a total of 19 residential units) be granted subject to the conditions and for the reasons stated or referred to in the report.

 

The Head of Planning Services informed Members that the site description contained in the report submitted was incorrect and should have indicated that the former London Hotel public house had been demolished and that the application site included the bowling club to the rear of the site. It was confirmed that this error was limited to the report submitted and that all site notices and correspondence had included the correct description of the site.

 

Members noted the information and agreed to consider the application on this basis.

 

RESOLVED:

 

That the recommendation be approved and the application be granted subject to the conditions and for the reasons stated or referred to in the report.
