Minutes:

The Committee considered the report of the Chief Planning Officer that recommended that the above application for the conversion of the existing detached garage into habitable accommodation space after erection of a single storey extension to the rear, dormer extensions and an infill extension to the side and bay windows to the front elevation, be granted, subject to the conditions and for the reasons stated or referred to in the report.

 

RESOLVED:

 

That the recommendation be approved and the application be granted subject to:-

 

(1)

the conditions contained in the report and as amended in the Late Representations; and for the reasons stated and referred to in the report and in Late Representations; and

 

(2)

an amendment to Condition 2, with the deletion of the statement:   ‘…unless authorised agreed in writing by the Local Planning Authority’. 

 

Therefore Condition 2 to read:

 

“Notwithstanding the provisions of the Town and Country Planning (General Permitted Development Order 2008 (or any subsequent Order or statutory provision revoking or re-enacting the provisions of the Order), the residential accommodation approved with this application shall not be converted to a self-contained residential dwelling.

 

Reason: In order to preserve the character and appearance of the Conservation Areas and to accord with NH11 in the Local Plan”.

Minutes:

The Committee considered the report of the Chief Planning Officer that recommended that the above application for a change of use from A2 (advice centre and offices) to 8 bed House in Multiple Occupation (HMO) including a dormer extension to the rear of the property (alternative to DC/201700879 refused 29/06/2017), be granted subject to the conditions and for the reasons stated or referred to in the report.

 

RESOLVED:

 

That the recommendation be not approved and the application be refused for the following reason: The proposal is considered to represent overdevelopment which would fail to provide an acceptable level of outdoor amenity space for the intended number of future occupiers. The positioning of a bin store inside the building would also be detrimental to the health and living conditions of future occupiers. Due to these reasons the resultant standard of living would be unacceptable; therefore the proposal conflicts with Local Plan policies SD2 and HC4, Supplementary Planning Document 'Houses in Multiple Occupation (HMO) and Flats' and the requirements of the National Planning Policy Framework, in particular paragraphs 9 and 17.

Adoption of Supplementary Planning Documents (SPDs) and Information Notes pdf icon PDF 91 KB

Report of the Chief Planning Officer

Minutes:

Further to Minute No. 55 of the meeting of Cabinet held on 7 September 2017, the Committee considered the report of the Chief Planning Officer advising of the adoption of 5 Supplementary Planning Documents (SPDs) and 2 Information Notes; and that 2 existing Supplementary Planning Guidance documents (SPGs) and 2 SPDs would no longer be used for planning purposes.

 

The report indicated that these were available to view at www.sefton.gov/spd .

 

 

RESOLVED:  That

 

(1)

the information contained in the report be noted;

 

(2)

it be noted that

 

(i)

the draft SPDs and Information Notes have already been used for Development Management purposes since they were approved for consultation purposes;

 

(ii)

the following Supplementary Planning Documents and Information Notes were adopted by the Council on 7 September 2017:

 

a)    Land east of Maghull SPD (including the Strategic Environmental Assessment (SEA) Report);

b)    Crosby Centre SPD

c)     Nature Conservation SPD

d)    Open Space SPD

e)    Control of hot food takeaways and betting shops SPD

f)      Developer contributions towards education provision Information Note

g)    Mineral Safeguarding Information Note; and

 

(iii)

the following Supplementary Planning Document and Supplementary Planning Guidance have been revoked and will no longer be used in determining planning applications:

 

·       Greenspace, Trees and Development SPG; and

2.     the implementation of an appropriate S.106 agreement; and

 

3.     any future application to vary the S.106 agreement to be referred back to Planning Committee for a decision to be made.”;
