Report of the Chief Planning Officer

Minutes:

The Committee considered the report of the Chief Planning Officer that recommended that the above application for variation of condition 3, removal of condition 4 and replacement of condition 5, pursuant to planning permission DC/2014/02092, (refused 25/02/2016) allowed on appeal ref: APP/M4320W/16/314893 dated 05/01/2017, to remedy a drafting error and to facilitate operations on the application site and adjacent land, be granted subject to conditions and for the reasons stated or referred to in the report.

 

Prior to consideration of the application, the Committee received a petition from Liverpool City Councillor Ann O’Byrne, on behalf of objectors, against the proposed development and a response by Mr. K Gallagher and Mr P. Clarke on behalf of the applicant.

 

Councillor Maher, as Ward Councillor, spoke in objection to the application.

 

RESOLVED:

 

That the recommendation be approved and the application be granted subject to the conditions and amended conditions, for the reasons stated or referred to in the report, in Late Representations and in addition, for condition 6 to refer to a 96 hour period rather than 48.

Report of the Chief Planning Officer

Minutes:

Further to Minute No. 72 of 14 November 2018, the Committee considered the report of the Chief Planning Officer that recommended that the above application for the erection of 14 detached dwelling houses and landscaping, retention of former farm house and demolition of existing outbuildings, be granted subject to the conditions and for the reasons stated or referred to in the report and the approval of a Section 106 Agreement.

 

Consideration of this application had been deferred from the previous meeting to enable the applicant to consider alternative access options, given the Local Plan requirement for the site to be served from Park View and the concern of local residents about access from Holgate.

 

Prior to consideration of the application, the Committee received a petition from Mr P Levick, on behalf of objectors, against the proposed development and a response by Mr Foxcroft on behalf of the applicant.

 

RESOLVED:

 

That the recommendation be not approved and the application be refused for the reasons that: It is a piecemeal development which does not meet the Council’s density standards; it does not meet one of the criteria in Appendix 1 of the Local Plan that access should be taken from Park View; and the impact of access on residents is unacceptable.

Minutes:

The Committee considered the report of the Chief Planning Officer which recommended that the above retrospective application seeking permission for a change of use for the repair, maintenance and cleaning of tank containers and as a general haulage depot, to include the erection of a detached building to allow repair works to take place indoors, be approved subject to the conditions and for the reasons stated or referred to in the report.

 

Prior to consideration of the application, the Committee heard from Councillor Maher, as Ward Councillor, speaking in objection to the application and a response from the applicant, Mr J Harper.

 

RESOLVED:

 

That the recommendation be approved and the application be granted subject to conditions and for the reasons stated or referred to in the report and in Late Representations; and

 

Subject to amendments to:

Condition 2 - restricting operational hours to 8.00 -18.00  Monday to Friday; 8.00 -13.00  Saturday; and

Conditions 2 and 3 - no working on Sundays or Bank Holidays except in emergencies, between hours of 8.00 am to 12.00.  Emergencies specified as not more than 10 occasions per year and a maximum of 2 lifts (of containers) on each occasion, and such occasions to be notified to the Planning Authority.

RESOLVED:

 

That consideration of the item be deferred to enable the applicant to conclude discussions on a number of matters with the Town Council, the Church and the local Scout Group.
