The Sub-Committee considered the report of the Director of Built Environment regarding an application by Oldy Leisure Limited for the Grant of a Premises Licence in respect of the above premises as follows:

 

·                    The sale of alcohol by retail (on and off the premises);

In addition to the matters outlined above, the applicant also wished to vary the Licence to include the following non-standard timings to be applicable to all licensable activities:

 

·                    The addition of one hour past the terminal hour for Good Friday, Christmas Eve, Boxing Day, Mothering Sunday and all Sundays that lead into a Bank Holiday Monday.

·                    An extension from the terminal hour until the hour of commencement on the 1st of January every year.

 

 

Objections to the application had been received and this necessitated a hearing for which the Sub-Committee had been convened.

 

The Sub-Committee heard representations from:

 

  • Mr Karl Barry, Safeguard Licensing Trade Consultancy – on behalf of the applicant, in support of the application;
  • Mr. Stephen Hughes, the Applicant, in support of the application;
  • Constable Steve Woods,on behalf of Merseyside Police objecting to the application; and
  • Parish Councillor Terry Baldwin from Aintree Parish Council objecting to the application.

 

The following preliminary issues were raised:

 

·        Cllr Kermode was in attendance as an Observer.  All parties agreed to this.

 

  • Mr Barry indicated that the application had been submitted on 17 April 2012 prior to implementation of changes made to the Licensing Act 2003 via the Police Reform and Social Responsibility Act 2011, which came into effect on 25 April 2012; and as such, the changes made by the 2011 Act did not apply to the application submitted by Oldy Leisure Limited.

 

  • Mr. Barry also queried whether Aintree Village Parish Council fell within the vicinity of the Club and whether or not there was a Designated Public Premises Order in force.
