RESOLVED:

That Councillor Blackburn be elected Chair for this meeting of the Sub-Committee.

Members and Officers are requested to give notice of any personal or prejudicial interest and the nature of that interest, relating to any item on the agenda in accordance with the relevant Code of Conduct.

No declarations of interest were received.

Report of the Director of Built Environment

The Sub-Committee considered the report of the Director of Built Environment regarding an application by Mr. Barry Whelan for the Grant of a Premises Licence in respect of the above premises as follows:

• The sale of alcohol by retail (on and off the premises)

·        The provision of regulated entertainment - live music;

• The provision of regulated entertainment - plays;
• The provision of regulated entertainment - films;
• The provision of regulated entertainment - indoor sporting events;
• The provision of regulated entertainment - recorded music;
• The provision of regulated entertainment - performance of dance;
• The provision of regulated entertainment - entertainment of a similar description to that falling within the category of live music, recorded music, or performance of dance;
• The provision of entertainment facilities - making music;
• The provision of entertainment facilities - dancing; and,
• The provision of entertainment facilities - entertainment of a similar description to that falling within the category of making music or dancing

• The provision of late night refreshment

• Hours premises to be open to the public

In addition to the matters outlined above, the applicant also wished to vary the Licence to include the following non-standard timings to be applicable to all licensable activities:

An extra hour for New Years Day, Valentines Day, Thursday before Good Friday, Good Friday, Easter Saturday, Easter Monday, Sunday and Monday of all Bank Holiday weekends, St Patrick’s Day, St David, St Andrew and St George’s Day. Christmas Eve and Boxing Day until 01.00, New Years Eve from 09.00 on 31/12 to 09.00 on 01/01.

Objections to the application had been received and this necessitated a hearing for which the Sub-Committee had been convened.

The Committee heard representations from:

• Mr. Barry Whelan –  the applicant, in support of the application; and
• Miss. S. Hughes on behalf of Mrs. A. Pettener, Mr. D. Ralston, Mr. T. Sullivan on behalf of the Seaforth Residential Action Group and Mr. A. Ritson, all objecting to the application.

• Councillors Keith and Roche were present as observers.  All parties agreed to this.

During his representations the applicant advised the Sub-Committee that he wished to amend his application as follows:-
