To seek approval for the introduction of waiting restrictions on Andrews Lane, Barton Heys Road and Andrews Close, Formby.
Decision(s):
(1) the implementation of a Traffic Regulation Order be approved, the effect of which will prohibit parking at any time on the westerly side of Andrews Lane, from a point 24m north of the northerly kerbline of Barton Heys Road, to a point 15m south of the southerly kerbline of Barton Heys Road;
(2) the implementation of a Traffic Regulation Order be approved, the effect of which will prohibit parking at any time on the south-westerly side of Andrews Lane, from a point 63m south of the southerly kerbline of Barton Heys Road, for a distance of 26m in a south-easterly, then easterly direction;
(3) the implementation of a Traffic Regulation Order be approved, the effect of which will prohibit parking at any time on the easterly side of Andrews Lane, from a point 15m north of the northerly kerbline of Andrews Close, to a point 30m south of the southerly kerbline of Andrews Close;
(4) the implementation of a Traffic Regulation Order be approved, the effect of which will prohibit parking at any time on the north-easterly side of Andrews Lane, from a point 77m south of the southerly kerbline of Andrews Close, for a distance of 19m in a south-easterly, then easterly direction;
(5) the necessary legal procedures, including those of public consultation and advertising the Council’s intention to implement the Orders, be approved;
(6) in the event that no objections are received during the consultation process referred to in (5) above, the Chief Legal & Democratic Officer be authorised to make the Order and the Highway Management Manager be authorised to implement the Order; and in the event that objections are received during the consultation process, the matter be referred to the Licensing & Regulatory Committee for consideration in accordance with the Council’s Constitution.
Reasons for the Decision(s):
The Council has the power to revoke a Traffic Regulation Order (Part IV of Schedule 9 to the Road Traffic Regulation Act 1984) as well as the power to make a new Traffic Regulation Order (Section 1 of that Act). Authorisation to advertise new Traffic Regulation Orders falls under the remit of Cabinet Member Locality Services.
