To seek approval for the Chief Legal and Democratic Officer, in conjunction with the Head of Highways & Public Protection to legally “adopt” an area of highway, as detailed within the report pursuant to section 228 of the Highways Act 1980.
Decision(s):
The Head of Highways & Public Protection be authorised, in conjunction with the Chief Legal and Democratic Officer to adopt areas of highway pursuant to section 228 of the Highways Act 1980, as detailed within the report and shown upon the attached plans: -
· Thomson Road, Seaforth – A section of the existing carriageway and footway on Gladstone Avenue, to the rear of 61 Thomson Road and an adjacent area of soft landscaping. As shown on the attached plan DC2179;
· Gladstone Avenue, Seaforth – An existing footpath from adjacent to 35 Thomson Road to 36 Green Lane and an adjacent area of soft landscaping. As shown on the attached plan DC2179;
· Hurst Road, Maghull – An area of highway fronting no.9 Hurst Road. As shown on the attached plan DC2180.
Reasons for the Decision(s):
Cabinet Member authorisation is required in order to allow the Local Authority to legally “adopt” and therefore maintain areas of highway which do not form part of the adopted highway network at the present time, under legislation contained within Section 228 Highways Act 1980.
