Purpose:

To seek approval for the Chief Legal and Democratic Officer in conjunction with the Head of Highways and Public Protection to negotiate and enter into agreements with the organisations listed within the report, under Section 278 of the Highways Act 1980 for the implementation of schemes of highway improvements associated with their developments, as detailed within the report.

 

Decision:

The Chief Legal & Democratic Officer be authorised in conjunction with the Head of Highways and Public Protection to negotiate and enter into agreements with the following organisations/companies pursuant to Section 278 of the Highways Act 1980 for the implementation of schemes of highway improvements associated with their developments, as shown upon the attached drawings numbered DC1997, DC1998, and DC2000 as detailed within the report  :

 

·        113A – 117 Norwood Road, Southport – Applicant – Barclays Properties (Southport), 71 Hesketh Road, Southport, PR9 6EL (reference DC/2017/01738)

 

·        2 Well Lane, Bootle – Applicant – Mr Steven Bolger, 1 Well Lane, Bootle, L20 3BR (reference DC/2018/00537)

 

·        Chinese Chef Foods, Musker Street, Crosby – Applicant – Gavin Whiteside, Old Lighthouse, 98 Liverpool Road, Formby, L37 6BS (reference DC/2018/01035).

 

Reasons for the Decision:

 

The decision is required in order to allow for the implementation of schemes of highway improvements in respect of the developments which have been granted conditional planning approval.

 

Alternative Options Considered and Rejected:

 

The alternative is not to enter into a legal agreement with works being carried out on the public highway outside the control of the Council.
