Apologies for absence were received from Councillors Carragher, Keith, McGinnity, and Lynne Thompson.

Declarations of Interest

Members are requested at a meeting where a disclosable pecuniary interest or personal interest arises, which is not already included in their Register of Members' Interests, todeclare any interests that relate to an item on the agenda.

 

Where a Member discloses a Disclosable Pecuniary Interest, he/she must withdraw from the meeting room, including from the public gallery, during the whole consideration of any item of business in which he/she has an interest, except where he/she is permitted to remain as a result of a grant of a dispensation.

Report of the Head of Highways and Public Protection

Minutes:

The Committee considered the report of the Head of Highways and Public Protectionthat reported on the receipt of one objection against a proposal to introduce a raised cycle friendly zebra crossing on Town Lane, Kew.

 

Prior to consideration of the report, the Committee received a petition by Mr. Tony Crabtree in objection to the proposal.

 

RESOLVED: That

 

(1)

the objection be noted;

 

(2)

the cycle friendly zebra crossing be progressed as originally advertised; and

 

(3)

the objector be advised accordingly.

Report of the Head of Highways and Public Protection

The Committee considered the report of Head of Highways and Public Protection which sought the approval for an adjustment to the fees and charges for Taxi Licensing services in 2019/20.

 

Prior to consideration of the report, the Committee received a petition by Mr. Joseph Johnson in objection to the proposal.

 

RESOLVED: That

 

(1)

 

(2)

the objection be noted;

 

the proposal to increase the enforcement capacity of the Taxi Licensing Enforcement Unit by one officer be endorsed;

 

(3)

the proposed uplift in fees to address the estimated shortfall in income and fund the increase in enforcement capacity be approved; and

 

(4)

the Head of Highways and Public Protection be authorised to advertise the revised fees and charges and set an implementation date of Monday 4 November 2019.

Public Path Dedication - Netherton Lane, Netherton pdf icon PDF 2 MB

Report of the Head of Highways and Public Protection

Minutes:

The Committee considered the report of the Head of Highways and Public Protection which sought authority to dedicate a section of Netherton Lane as a Public Bridleway and upgrade a section of Sefton Footpath No.14 as a bridleway; and to modify the Definitive Map and Statement of Public Rights of Way accordingly.

 

RESOLVED: That;

 

The Chief Legal and Democratic Officer be authorised in conjunction with the Head of Highways and Public Protection to:

 

(1)

dedicate a section of Netherton Lane as a public bridleway pursuant to Section 1 of the Localism Act 2011 as shown on plan DC1989, to be known as Sefton Bridleway No. N14;

 

(2)

dedicate a section of Sefton Footpath No.14 as a bridleway pursuant to Section 1 of the Localism Act 2011 as shown on plan DC1991 and to rename it as Sefton Bridleway No. N14; and

 

(3)

make the Legal Event Modification Orders under the provisions of Section 53 of the Wildlife and Countryside Act 1981 to record the additional way as shown on plan DC1990 on the Definitive Rights of Way Map and Statement, and the change of status of a section of Sefton Footpath No.14 to a bridleway as shown on plan DC1992.

Georgia Close, Bootle – Proposed Permit Parking Area Zone 421 pdf icon PDF 844 KB

Report of the Head of Highways and Public Protection

Minutes:

The Committee considered the report of Head of Highways and Public Protection which reported on the results of a consultation with residents on a proposal to introduce a residents’ permit parking scheme in Georgia Close, Bootle.

 

RESOLVED: That

 

(1)

the results of the public consultation be noted;

 

(2)

the progression of a Traffic Regulation Order, the effect of which will introduce a Residents’ Permit Parking Scheme to operate at all times on Georgia Close, Bootle, be supported;

 

(3)

the Cabinet Member Locality Services be requested to authorise the progression of the necessary Traffic Regulation Orders, including those of public consultation and advertising the Council’s intention to implement the Order;

 

(4)

the progression of the recommended Traffic Regulation Order be supported, subject to the scheme being funded from the delegated s106 budget for Linacre Ward;

 

(5)

in order to simplify Sefton’s Traffic Regulation Orders, current Orders which exist on any of the roads affected by this proposal will be revoked and new Orders made, incorporating the new amendments and in this respect, the following Orders will be revoked and replaced with a new Order:

Metropolitan Borough of Sefton (Georgia Close, Bootle) (On-Street Parking Places, Prohibition and Restriction of Waiting);

 

(6)

in the event that no objections are received during the consultation process referred to in (3) above, the Chief Legal and Democratic Officer be authorised to implement the Order and the Manager – Highways Management be authorised to implement the Order; and

 

(7)

in the event that objections are received during the consultation process, the matter be referred to a future meeting of this Committee for consideration.

Determinations made under the Licensing Act 2003 and the Gambling Act 2005: period covering 18 May 2019 to 16 August 2019 pdf icon PDF 73 KB

The Committee considered the report of the Head of Highways and Public Protection updating on applications made under the Licensing Act, 2003 and the Gambling Act 2005, which had been determined by Licensing Officers.

 

The report indicated that Sefton Council’s Statement of Licensing Policy (issued under the Licensing Act 2003) and the Statement of Gambling Policy (issued under the Gambling Act 2005), both followed the recommended delegation of functions contained within the Guidance issued under Section 182 of the Licensing Act 2003 and the Guidance issued under Section 25 of the Gambling Act 2005.  Where there are no relevant representations to applications, then these matters would be dealt with by Officers in order to speed matters through the system. The Guidance also recommended that where powers had been delegated, the Committee would receive regular reports on decisions made by Officers in order to maintain an overview of the general licensing situation.

 

The report indicated that during the period 18 May 2019 to 16 August 2019 the Head of Highways and Public Protection had received and determined the following numbers of applications:

 

Under the Licensing Act 2003:

 

  • 82 Applications made under Premise Licences
  • 34 Applications made under Personal Licences
  • 1   Application made under Club Premise Certificates
  • 74 Notifications of Temporary Event Notices
  • 67 Notifications of Late Temporary Event Notices

 

Under the Gambling Act 2005:

 

  • 2 Applications made under Licensed Premises Gaming Permits
  • 3 Notifications given for Licensed Premises Automatic Gaming
  • 1 Application made under Club Machine Permits

 

Details of the determinations were indicated in annexes 1 and 2 of the report.

 

RESOLVED:

 

That the report and the fact that further update reports would be submitted as necessary be noted.

Report of the Head of Highways and Public Protection

The Committee considered the report of the Head of Highways and Public Protection which sought the approval of a formal arrangement pursuant to Section 101 of the Local Government Act 1972 with neighbouring authorities, to facilitate cross border enforcement with regards to licensed hackney carriage and private hire vehicles.

 

RESOLVED: That:

 

(1)

the proposed agreement between Sefton MBC, Liverpool City Council and Knowsley MBC to facilitate cross border enforcement in respect of licensed hackney carriage and private hire vehicles, pursuant to Section 101 of the Local Government Act 1972, be approved; and

 

(2)

approval be given for the Head of Highways and Public Protection to authorise certain officers from the other named Councils to carry out enforcement and compliance functions in respect of Sefton licensed vehicles working in their areas.
