Apologies for Absence

Minutes:

An apology for absence was received from Councillor Morris.

 

2.

Declarations of Interest

Members are requested at a meeting where a disclosable pecuniary interest or personal interest arises, which is not already included in their Register of Members' Interests, todeclare any interests that relate to an item on the agenda.

 

Where a Member discloses a Disclosable Pecuniary Interest, he/she must withdraw from the meeting room by switching their camera and microphone off during the whole consideration of any item of business in which he/she has an interest, except where he/she is permitted to remain as a result of a grant of a dispensation.

 

Where a Member discloses a personal interest he/she must seek advice from the Monitoring Officer or staff member representing the Monitoring Officer to determine whether the Member should withdraw from the meeting room, including from the public gallery, during the whole consideration of any item of business in which he/she has an interest or whether the Member can remain in the meeting or remain in the meeting and vote on the relevant decision.

4.

The Committee considered the report of the Head of Economic Growth and Housing which sought Member’s approval to re-issue Safety Certificates for two regulated viewing grandstands at Southport FC’s Haig Avenue stadium, in order to include the name of the Club’s new Secretary who will be the holder of the certificates. A Safety Certificate needed to be granted in accordance with the Safety of Sports Grounds Act 1975 and the Fire Safety and Safety of Places Sports Act 1987.

 

RESOLVED:

 

That the re-issue of the General Safety Certificates for the Main Grandstand and for the Jack Carr Stand at Southport FC’s Haig Avenue stadium be agreed.

 

5.

Douglas Place, Bootle - Proposed 20mph speed limit pdf icon PDF 623 KB

Report of the Head of Highways and Public Protection.

Minutes:

The Committee considered the report of the Head of Highways and Public Protection which informed the Committee of the results of a consultation with residents regarding the proposal to introduce a 20mph speed limit on Douglas Place, Bootle. This was in order to rectify the omission of Douglas Place, Bootle from a 2011 Sefton Council policy which stated that the speed limit on all residential areas within Sefton, with the exception of main distributor roads, should be reduced to 20 mph as part of a rolling programme over subsequent years.

 

RESOLVED: That:

 

(1)

the results of the consultation be noted; and

 

 

(2)

the Cabinet Member – Locality Services be requested to consider authorising the advertising and progression of the 20mph speed limit Traffic Regulation Order on Douglas Place, Bootle.

 

 

6.

Report of the Head of Highways and Public Protection.

 

Minutes:

The Committee considered the report of the Head of Highways and Public Protection which informed the Committee of the results of a consultation with residents on Longdale Lane, Lunt, regarding the proposal to introduce a Residents’ Privileged Parking scheme.

 

RESOLVED: That

 

(1)

the results of the consultation be noted; and

 

 

(2)

the Cabinet Member – Locality Services be requested to authorise the progression of the necessary Traffic Regulation Order.

Minutes:

The Committee considered the report of the Head of Highways and Public Protection which outlined the work carried out during 2020/21 by the Local Licensing Unit.

 

RESOLVED: That

 

(1)

the report be noted; and

 

 

(2)

it be agreed that similar reports be submitted for consideration by this Committee on an annual basis.

 

 

8.

Minutes:

The Committee considered the report of the Head of Highways and Public Protection which reported on the progress of the Taxi Licensing service during 2020/21.

 

RESOLVED: That

 

(1)

the contents of the report be noted;

 

 

(2)

it be agreed that similar reports be submitted for consideration by this Committee on an annual basis. and

 

 

(3)

approval be granted for accredited training providers to conduct knowledge tests on a temporary basis with the maximum fee chargeable set by the Council.

 

 

9.

Final draft revised Statement of Gambling Licensing Policy – Gambling Act 2005 pdf icon PDF 77 KB

The Committee considered the report of the Head of Highways and Public Protection which sought Member’s comments on the final draft revised Statement of Gambling Licensing Policy and to then refer to Council for approval.

 

RESOLVED: That

 

(1)

the final draft of the revised Statement of Gambling Licensing Policy, attached at Annex 2, be agreed; and

 

 

(2)

the agreed revised Statement of Gambling Licensing Policy be referred to Council for approval.

 

10.

Determinations made under the Licensing Act 2003 and the Gambling Act 2005: period covering 19 February 2021 to 13 May 2021 pdf icon PDF 73 KB

The Committee considered the report of the Head of Highways and Public Protection updating on applications made under the Licensing Act, 2003 and the Gambling Act, 2005 which had been determined by Licensing Officers.

 

The report indicated that Sefton Council’s Statement of Licensing Policy (issued under the Licensing Act 2003) and the Statement of Gambling Policy (issued under the Gambling Act 2005), both followed the recommended delegation of functions contained within the Guidance issued under Section 182 of the Licensing Act 2003 and the Guidance issued under Section 25 of the Gambling Act 2005. Where there were no relevant representations to applications, then these matters would be dealt with by Officers in order to speed matters through the system. The Guidance also recommended that where powers had been delegated, the Committee would receive regular reports on decisions made by Officers in order to maintain an overview of the general licensing situation.

 

The report indicated that during the period 19 February 2021 to 13 May 2021 the Head of Highways and Public Protection had received and determined the following numbers of applications:

 

Under the Licensing Act 2003:

 

·       48 Applications made under Premise Licenses

·       30 Applications made under Personal Licenses

·       6 Notifications of Temporary Event Notices

·       4 Notifications of Late Temporary Event Notices

 

No Applications have been determined under the Gambling Act 2005 during this period.

 

RESOLVED:

 

That the report and the fact that further update reports would be submitted as necessary, be noted.

Additional Meeting - Highway Improvement Schemes

To agree an additional meeting to be held on Monday 1st November 2021 at 18:30.

RESOLVED: That an additional meeting of the Licensing and Regulatory Committee for consideration of highway improvement schemes be scheduled to take place at 6.30 pm on Monday 1 November 2021.
