Report of the Assistant Director of Place (Highways and Public Protection)

The Sub-Committee considered the report of the Assistant Director of Place (Highways and Public Protection) regarding an application for review of a Premises Licence by Merseyside Police in respect of the above premises.


A review application had been received from Merseyside Police and this necessitated a hearing for which the Sub-Committee had been convened.


The Sub-Committee heard representations from Merseyside Police in support of the application.


The Sub-Committee also heard representations from Oath Capital Limited (Premises Licence Holder) and Gill Sherratt (Premises Representative) in objection to the application.


Prior to the presentation of CCTV footage from Merseyside Police, under Regulation 14(2) of The Licensing Act 2003 (Hearings) Regulations 2005 (as amended) on the basis that the public interest in excluding the press and public outweighed the public interest in that part of the hearing taking place in public. .


The press and public were invited back into the meeting following the presentation of the CCTV footage.


At the end of their representations, Merseyside Police, Oath Capital Limited and Gill Sherratt confirmed that they were satisfied they had said all they wished to say.


The Sub-Committee retired under Regulation 14(2) of the Licensing Act (Hearings) Regulations 2005 (as amended) and thereby excluded the press and public whilst they reached their decision on the application. The Sub-Committee returned to give their decision in public.







the Premises Licence in respect of Oath Lounge, 211-213 Lord Street, Southport, PR8 1PF be suspended for a period of one month; and



the DPS Mr James Matthews be removed from the Licence.


The conditions of the licence be modified by inserting the following conditions :


·       On first appointment, all staff employed at the premises will receive training on the licencing input on preventing underage sales, preventing sales of alcohol to people who are drunk and any other relevant matters. Training shall be regularly refreshed at no less than annual intervals. The training must be recorded and be accessible on the premises and made available for inspection upon request of a Police Officer or an authorised officer of the Licensing Authority or (in the case of online training) within 48 hours.


·       An authorisation of alcohol sales form will be completed and will show all persons authorised to make sale of alcohol at the premises. The form will be signed and dated by the DPS and will be made available to Police Officers and authorised officers of the Licensing Authority on reasonable request.


·       All incidents of crime and disorder will be recorded in an incident book to be kept at the premises and made available to an authorised officer of the relevant responsible authority and/or Police Officer.


·       (to be inserted after challenge 25 policy condition already in annex 2 of the licence) All refusals of sale must be documented into a book when the refusal is made.
