Report of the Director of Built Environment Additional documents: Minutes: The Committee considered the report of the Director of Built Environment on an application under the Local Government (Miscellaneous Provisions) Act 1982, for the grant of a Sex Establishment (Sexual Entertainment Venue) Licence in respect of the above premises, as follows:

The report indicated that these premises had previously been granted a Sexual Entertainment Venue Licence by the Licensing (Sexual Entertainment Venues) Sub-Committee on 29th May 2012, but that this had been to a different operator who no longer had any interest in the premises. This Licence was due to expire without renewal on 28th May 2013.
The report indicated that no public objections had been received in respect of this new application, which had been advertised in the prescribed manner.
As agreed by the Sub-Committee held immediately before this meeting, the application for the grant of a Sex Establishment (Sexual Entertainment Venue) Licence was considered in close conjunction with that of the Application for the Variation of the Premises Licence for the same premises (Minute No. 3 of the Licensing Sub-Committee of 10/04/13 refers).
Constable Woods indicated that Merseyside Police had no particular issues to raise in respect of the application, excepting that the standard conditions for this type of Licence conflicted with the applicant’s proposed Variation of the Premise Licence for the same premise, issued under the Licensing Act 2003.

All parties agreed the issues that were in contention and the procedure that was to be followed. There were no further preliminary issues raised, and at the end of their representations, everyone confirmed that they were satisfied that they had said all they wished to say.
The Sub-Committee retired under Regulation 14(2) of the Licensing Act (Hearings) Regulations 2005 (as amended) and thereby continued to exclude the press and public whilst they reached their decision on the application. The Sub-Committee returned to give their decision in public.
RESOLVED:
That the application for the grant of a Sex Establishment (Sexual Entertainment Venue) Licence in respect of the Black Orchid Gentlemen’s Club, 8 Coronation Walk, Southport, be granted as requested, subject to the Council’s Sexual Entertainment Venue Standard Conditions Nos 1 to 5 and 7 to 12 (omitting Standard Condition No. 6).
The hours of operation are in accordance with the application made, namely: Monday to Sunday -14.00 to 06.00 hours.
Reasons:
The Sub-Committee could see no reason not to grant the Sex Establishment (Sexual Entertainment Venue) Licence subject to the agreed Conditions and in accord with the Operating Hours requested.
